As a general rule, tax debts cannot be discharged through a bankruptcy filing. If the tax bill is over three years old and your tax returns were timely filed, you may be able to discharge the debt. In all instances, however, you can include tax arrearages in a Chapter 13 plan. If you do, interest and penalties will not be assessed on the tax liability during the repayment period.
