Chapter 13 of the U.S. Bankruptcy Code allows you to restructure your debt and set up payment plans with your creditors. When you file for protection under Chapter 13, the bankruptcy court issues an Order for Relief, which imposes an automatic stay on all your creditors. This prohibits creditors from contacting you or taking any action against you to recover a debt.

Chapter 13 allows you to set up a 36 month, 48 month or 60 month repayment plan. If you stay current on your obligations during the repayment period, all your debt will be relieved. To qualify for a Chapter 13 bankruptcy, you must have a steady job and the bankruptcy court must determine that the repayment plan you have proposed is fair and reasonable to you and to your creditors.
